1. Interpretation and Definitions


Interpretation


The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:


  • Account means a unique account created for You to access our Service.
  • Company (referred to as "the Company", "We", "Us" or "Our") refers to VeCar Digital Programming LTD, Gregs Buildings, 1 Booth Street, Manchester, United Kingdom, M2 4AD (Company Number: 14385784).
  • Device refers to the physical MyVeCard NFC card provided by the Company.
  • Service refers to the MyVeCard SaaS platform, the Website, and the digital business card management system.
  • Content refers to any text, images, logos, or information uploaded by You to the Service.
  • You means the individual or legal entity accessing or using the Service.


2. Acknowledgment


These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. By accessing the Service or purchasing a Device, You agree to be bound by these Terms.


3. Payments and Subscriptions


Our Service uses Stripe as a third-party payment processor. By purchasing a Device or a Subscription, You agree to be bound by Stripe’s Terms of Service.


  • All fees are non-refundable except as specifically stated in our Replacement Policy.
  • For active subscriptions, we will provide at least 30 days' notice of any price changes.


4. Physical Device, Global Shipping, and Replacement Policy


  • Local Fulfillment: To ensure faster delivery and reduce environmental impact, the Company uses a global network of local printing partners ("Virtual Printers"). Orders are generally routed to the printer nearest to Your location.
  • Shipping & Customs: Delivery times are estimates. The Company is not liable for delays caused by local postal services or customs. Any local import duties or sales taxes (e.g., US Sales Tax, VAT outside UK) are the responsibility of the Customer.
  • Non-functioning Devices: If Your NFC Device is defective, You must notify Us within 14 days of receipt. We will provide a replacement within 14 business days after technical verification.
  • Strict No-Refund Policy on Customization: In accordance with the UK Consumer Rights Act, EU Directive 2011/83/EU, and US commercial standards, no refunds or cancellations are permitted once a personalized order (e.g., cards printed with Your logo or name) has entered the production phase, as these goods cannot be resold.


5. User Content and Data Responsibility


  • Responsibility: You are solely responsible for the Content You upload. You represent that You own all rights to such Content and it does not violate any third-party copyrights or trademarks.
  • Sensitive Data: You are advised not to upload highly sensitive personal data. The Company is not liable for any misuse of information that You choose to make public through the Service.


6. Limitation of Liability (US & Global Standards)


  • General Limit: To the maximum extent permitted by law, the Company's total liability shall not exceed the amount actually paid by You for the Service during the 12 months prior to the claim.
  • FOR US USERS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.


7. Termination


We may terminate or suspend Your Account immediately, without prior notice, if You breach these Terms and Conditions.


8. Governing Law, Arbitration and Class Action Waiver


  • Governing Law: These Terms are governed by the laws of England and Wales.
  • Dispute Resolution: If You have any concern, You agree to first try to resolve the dispute informally by contacting the Company.
  • US Users & Class Action Waiver: If You are accessing the Service from the United States, You agree that any dispute shall be settled by binding arbitration. YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
  • International Compliance: You represent that You are not located in a country subject to UK, EU, or US government embargoes.
